Terms and Conditions

These Terms and Conditions (Terms) and any other Terms and/or Policies referred to in these Terms, such as our Privacy Policy, apply between you (the buyer) and 10×8 Photography (10×8), (the seller, “we”, “our”, “us”) when you purchase or use our products and services. Our business address is Penshell Bakery, Penshell House, Kilkhampton, Bude, Cornwall, EX23 9QJ. By ordering from us, you agree to these Terms. If you do not understand or do not accept these Terms, do not place an order with us.

Privacy

By placing an order with us, you consent that we are authorised to store and provide any relevant personal information to trusted third parties to verify, fulfil and deliver your order.

Ordering & Payment

Payment Methods

By placing an order for a product or service on our website, you permit us or our payment partners to charge your credit card, debit card or other payment method chosen, for the total amount of your order, including any applicable shipping charges and tax.

Order Acceptance

All orders placed are subject to our acceptance. This means that we may refuse to accept your order. We reserve the right to cancel an order for any or no reason, and without liability to you, us or any other party. If we have already taken payment, we will issue you a refund.

When an order has been accepted by us, you will be notified by email which will show your order details, including an order number. At this stage your order may still be subject to acceptance.

If you do not receive an order acknowledgement email, please check it has not been directed into an email spam folder. Please contact us if you require us to send a new copy of the email.

Course Fees and Payment Methods

Fees are due in full at time of booking. We accept secure payment via PayPal both by credit and debit card (you do not need a PayPal account) and also from PayPal account holders. At no time do PayPal share any of your financial details (card number, expiry date, security code etc.) with us.

We also accept payment by bank transfer, our bank details will be provided after booking online. We must receive cleared funds at least seven days prior to the course date or the first course date if booking multiple courses. We reserve the right to release the course place/s if payment has not been received within seven days of receiving the booking.

Discount voucher codes cannot be combined at time of booking. The single highest discount only will apply to any booking unless otherwise specified.

Prices & Taxes

VAT & Tax

All prices displayed on our site are inclusive of VAT, where applicable, at the current rate.

Packing & Shipping

Prices displayed on our site, where applicable, include shipping using a UK based courier service, unless otherwise stated.

Pricing Mistakes & Changes

Every effort is made to prevent pricing errors on our website. In the unlikely event you are charged the incorrect price, you agree that we are not bound by that incorrect price. We will contact you as soon as possible to inform you of the correct price. We may suggest a product substitution (at the same or different price) or a price modification. If you do not agree to either of these two proposed solutions we will cancel your order and refund any money you have been charged.

We reserve the right to change our product prices at any point and without notice.

Custom Quotations

Custom quotations which may be created manually by us are valid for 30 calendar days from the point we send them to the contact details you supplied.

On rare occasions where a quotation has been generated incorrectly we will inform you of any price changes immediately. You agree that we are not bound by an incorrect price.

Promotional Codes

If you possess and apply a promotional code to your order, you agree to be bound by the following:

  • Promotional codes can only be used online and cannot be applied to previously placed orders.
  • Promotional codes are not redeemable for cash or credit.
  • Promotional codes that offer money off, for example a percentage discount, can be applied to all standard priced retail orders made online, but may not be combined with any other promotional code or offer.
  • Some promotional codes are available to use multiple times within the offer period whereas some promotional codes can be used only once. We will make it clear what type of promotional code we are sending to you.
  • Some promotional codes may be shared with others and this will be made clear.
  • We reserve the right to cancel any order or refuse to apply a discount due to unauthorised or ineligible use of a promotional code. In such cases we may cancel your order and refund your money.
  • We reserve the right to withdraw or amend a promotional code for any reason we deem necessary.
  • Refunds for orders with a promotional code will not include the value of the promotional code. You will receive no more than the amount you paid towards the order.

Promotional codes received from us by email will list the expiry date, as well as the exact discount offered and any exclusions or special conditions.

Promotional codes can be applied to your basket before checkout.

Delivery & Dispatch

Defects & Damages

If you receive goods that are defective or damaged you should contact us within 14 calendar days of accepting delivery. We may choose to have the goods collected and in addition to your consumer rights, you may be given the option to have the product(s) replaced at no charge to you. Your failure to inform us after 14 calendar days of you accepting delivery shall constitute a waiver of any such claim.

Failed Deliveries

Where an item has been returned to us due to an incorrect or incomplete delivery address being supplied, you may be charged a reshipping fee to attempt delivery of your order again.

Where an item has been returned to us due an error on our or our carrier’s part, you will not be charged for redelivery of your order.

Incorrect Shipping Location Selected

Where you have selected an incorrect delivery location for purposes of calculating shipping charges, we reserve the right to cancel your order or charge you the correct amount.

Undeliverable Locations

We may not be able to deliver to your chosen location. If we can’t ship to your chosen location we will cancel your order and refund you the total value of your order; or give you the option to arrange collection and delivery yourself. You will be responsible for paying delivery charges on delivery services organised yourself.

Where we can’t deliver to your chosen location, but have begun production of an order containing customised products we may not be able to cancel your order. It is your responsibility to ensure we can deliver to your chosen delivery address before you place an order. To determine if we can ship to your destination, please contact us. We currently only ship to UK addresses.

Imports & Exports

Your order may be subject to import and export laws, regulations and taxes. You must ensure that your order complies with any legal requirements applicable to the products you have ordered.

International shipments may be subject to customs taxes and duties. As the recipient it is your responsibility to pay any charges that arise as a result of any customs taxes and duties. We do not have the capability to inform you of customs charges before you checkout. We currently only ship to UK addresses.

Lead Time

All lead times quoted on our website refer to business days (days not including weekends and holidays, including any Christmas or other shut down and bank holiday periods). These are estimated lead times and are not guaranteed.

Products

Descriptions & Photographs

We make every effort to prevent errors relating to the description or specification of a product or service appearing on our website. If in the unlikely event you receive a product that has been incorrectly described, we will offer you a substitution or refund. Should the substitution cost more than your incorrectly specified product(s), you are responsible for paying the difference. Conversely, if your chosen substitution is cheaper, we will refund you the difference.

Some product images on the website are illustrations and not actual photographs of products and as such are only a representation of the final finished product that you will receive. Where photographs of products are used, these have been taken under studio lighting with professional quality camera equipment. Photographs have also been colour corrected using calibrated monitors, by experienced professional photographers. We cannot guarantee that the photos you see on screen will look identical to what you receive because:

  • Your monitor may not display colours accurately
  • Batches of material can vary
  • Different lighting environments can have an effect on perceived colours

For these reasons, if exact colour, material or other specification is important to you, we suggest you contact us.

Where we deem that the product supplied is a reasonable match to that displayed on our website we may not accept responsibility for replacing or refunding your order.

Availability & Stock

If you have ordered an out of stock item we will contact you to ask if you are happy to wait. If you choose not to wait, we will offer you a substitution or refund. Should the substitution cost more than the out of stock product(s), you are responsible for paying the difference. Conversely, if your chosen substitution is cheaper, we will refund you the difference.

Gift Vouchers

All gift vouchers are valid for a period of one year from the date of issue. The expiry date will be clearly visible on the gift voucher that we send you. Gift vouchers can be used in in full or part payment when placing an order, however, they must be used in full in a single transaction. Gift vouchers will be provided electronically by email to the email address you provide when placing your order.

Returns, Refunds, Cancellations & Changes

In placing an order with us you agree to the following Return & Refund Policy.

Cancellations & Changes

Bookings may be cancelled and you will receive a full refund or can rebook to an alternative date free of charge up to eight weeks (56 days) prior to the booked course date.

Bookings cancelled or transferred with less than eight weeks (56 days) notice and more than two weeks (14 days) notice are eligible for a 50% refund for cancellation and a 50% rebooking fee for transfers to an alternative date at our sole discretion.

Bookings cancelled or transferred with less than two weeks (14 days) notice are not eligible for refund and a full 100% booking fee will apply to any rebooked course at the lower of the original price or the current price.

We reserve the right to cancel any event for any reason. If this happens all fees will be refunded or an alternative date offered at the same price but no other claims will be considered.

Delegates must be aged 18 years or over unless accompanied by an adult.

Returns

Please inform us of your intent to return an order in part or in full through our contact form.

Please ensure that in the event of us organising a carrier to collect your return that you have packaged the product(s) and its associated accessories securely and that you have indicated your Returns Authorisation (RA) number on the packaging.

Please note that you may not return products, except in the case of damage or incorrect supply.

Refunds

Once we receive your return and have checked that it conforms to the original returns authorisation we will initiate a refund immediately.

The way in which your refund is processed will change according to your original payment method. Payments made by card will be issued to the issuing bank within five business days. Payments made by cheque, BACS or cash will be refunded by BACS within five business days.

An authorised return will result in a full refund covering all costs associated with the product(s) returned. Note that refunds will not be issued for express delivery costs or any part of the standard shipping costs if only part of an order is returned.

Unauthorised Returns

Any goods returned without an RA number will be held for three months from date of receipt. During that time you will have the option for us to return the goods to you at your expense, or arrange collection.

Limitation of Liability

We will not under any circumstances be liable for any consequential loss as a result of the incorrect supply, late delivery, accidental misrepresentation or any other reason whatsoever whether avoidable or not.

This website may contain links to external sites. We will not be held responsible for the availability of, or the content located on or through, any external site, nor for any transactions between you and such sites.

Copyright

You may not download or copy the content or other downloadable items displayed on this website for personal or commercial gain unless authorised to do so by a member of our management. Copying or storing the contents of this website is strictly forbidden.

Changes

From time to time we may update this policy. When any changes are made, the policy will be updated on our website. We will never diminish your rights with changes to this policy, unless you have given explicit consent. Placing an order after a change in policy constitutes to providing explicit consent.

This policy is effective from 1st June 2018.
